No. A flat fee describes how a lawyer prices the work, not how good the lawyer is. Hourly billing and flat fees are simply two ways of charging for the same legal services. Why do people assume flat fees mean lower quality?
For most of the legal industry's history, lawyers have billed by the hour, so hourly billing became associated with "serious" legal work, and flat fees with simple, low-cost services. But the billing method does not change the law, the court, or the work a case requires. It only changes who carries the risk of the case taking longer than expected. Under hourly billing, the client carries that risk. Under a flat fee, the firm does.
What actually signals a strong divorce lawyer?
Whatever the billing method, look for:
- A focus on family law. Divorce, custody, and support law has its own procedures, local court practices, and judges.
- Experience in your court. Familiarity with Jefferson Family Court in Louisville, or Davidson County's courts in Nashville, matters.
- Recognition from independent organizations, not just the firm's own claims. Check who gave the recognition and when.
- Communication. Ask how quickly the firm responds and how you will get updates.
- Honesty about your case. A strong lawyer explains the risks, when settlement makes sense, and never guarantees a result.
